HP: Vehicle Finance

We mainly provide finance on regulated Hire Purchase Agreements. That’s the traditional method of vehicle finance, where you keep the car when the debt is settled.

PCP: Vehicle Finance

We also offer PCP Agreements. At the end of the term you pay a ‘balloon’ payment, or hand back the vehicle.

COMMISSION COMPLAINTS UPDATE

THE BACKGROUND

Back in January 2021, the Financial Conduct Authority (FCA) banned Discretionary Commission Arrangements on Motor Finance Agreements as it considered them to be unfair.
This was followed by some Court cases that tested when commission might be considered fair or unfair, and what redress payment might be appropriate if the customer had been treated unfairly.
Rather than rely on the need for the customer to complain, the FCA proposed a Redress Scheme, that would define when a Motor Finance Agreement had been unfair, what amount of redress should be paid, and when the lender should pay redress to the customer.
And this would happen under the Redress Scheme regardless of whether the customer had complained.
So there would be no need for a Claims Management Company to act on the customer's behalf, enabling the customer to receive all of the redress payment without taking any action whatsoever.

The FCA identified "Relevant Arrangements", which are the 'triggers' that in most cases will make the Motor Finance Agreement unfair, resulting in a Redress Payment being paid to the customer.

Discretionary Commission Arrangement

Where the dealer could influence the interest rate in order to increase their commission.

High Commission

Where the dealer could influence the interest rate in order to increase their commission.

Tied Arrangement

Where the dealer could influence the interest rate in order to increase their commission.

ACTIONING THE REDRESS SCHEME

The FCA require lenders to:
1. Analyse all Motor Finance Agreements that were signed up since April 2007
2. Identify which Agreements, if any, incorporated a Relevant Arrangement
3. Calculate the Redress Payment due (if any)
4. If analysis shows that the agreement was unfair: Contact Customers to provide a Provisional Redress Decision, offering a Redress Payment
5. If the analysis shows that the agreement was fair: Contact Customers who have complained, to provide a Provisional Redress Decision, to let them know that there is no Redress Payment due
Note: Where the customer has used a claims management company, the lender may be required to contact the claim firm, not the customer.

HOW THIS APPLIES TO STOUR VALE FINANCE CO LTD

We have completed an analysis of all Motor Finance Agreements going back to April 2007.
This shows that there are no Relevant Arrangements on any of the Agreements.
Therefore, no Redress Payments are due.
As primarily a sub-prime lender, operating solely in the West Midlands area, we anticipated that our agreements would fall into the 63% of Agreements that the FCA estimated would be considered to be fair under the Commission Redress Scheme. So the outcome of our analysis is consistent with expectations. Initially we have responded to all complaints to acknowledge receipt.
And subsequently we have provided an update to state that we will not be making any redress payments under the FCA's Redress Scheme.
In accordance with the FCA's Redress Scheme requirements, between 1st August 2026 and 30th November 2026, we will be contacting customers who have complained (or their Claims Management Company) to provide a 'Provisional Redress Decision', stating that no redress payments are due.

FCA UPDATE JULY 2026

Due to challenges to the Redress Scheme from lenders and consumer groups, the FCA have suspended the Redress Scheme elements that involve redress payments.
However, where no redress payment is due, the FCA require lenders to still proceed in line with the Redress Scheme requirements.
Although the dates for getting in touch with the Provisional Redress Decision have been pushed back:
- 18th November 2026: where the Agreement began on or after 01/04/2014, and the complaint was received by 30/06/2026
- 18th January 2027: where the agreement began before 01/04/2014 and the complaint was received by 31/08/2026

NOTE: If you are not happy with our decision to not pay any redress, you can:
- Ask us to review the decision And if you are still not happy with the outcome, you can:
- Ask the Financial Ombudsman to review your complaint; or
- Consider court action
